What is negligence?
When someone is negligent, it means the behavior of the person has been careless, reckless and stupid. This behavior may cause harm or damage to another person. Negligence is an act of doing things being negligent. It means neglecting the correct way of doing things. We can call a person being negligent when he or she does things that otherwise should not have been done. When it comes to road and traffic, not stopping your car in a zebra crossing, or not turning on lights of your car while driving at night can be called negligence. The impact of negligence is usually negative or bad.
Negligence is used as a legal theory in car accidents. A driver must be careful in order to avoid any mishap on the road. If a driver is not careful while driving it might result in the accident of the car or injury of a pedestrian.
Your duty as a driver to avoid accident caused by negligence
It is required by the law that driver on the road take extra precautions for the safety of the passengers and the pedestrians. How is this achieved then? Below are some of the precautions that driver must follow while on the road.
- Drive with controlled speed
It is the duty of a driver to drive their vehicle at prudent speed. Rash riding has been contributing to the accidents and hence it is advisable to drive your vehicle with speed that is controllable. You must understand the fact that based on the condition of weather, road and other traffics sometimes driving at the limit can be considered as negligence.
- Driving with alert and vigilance
While on the road a driver must be vigilant and alert. You must always look out for possible obstructions that might come while you are driving. You must be alert for any tough situation. This becomes more important if you are driving at the night time or during bad weather.
- Maintaining the car and its equipment
It is the driver’s responsibility to maintain the car he/she drives along with the equipment attached to the car. A properly maintained and checked car will have less probability of having an accident while on the road.
There are other duties and responsibilities that driver must follow in order to avoid accidents due to negligence. It must be kept in the mind that it is driver’s responsibility to keep himself and the pedestrian safe.
